A forensic expert testified that thousands of web searches for pornography were found on four computers used by the Country Club Hills Fire Department. The testimony was part of a legal case involving Dena Lewis-Bystrzycki, a female firefighter who is suing the department.
Andrew Garrett, the expert who conducted the digital imaging in January, revealed during his testimony that the hard drives had been wiped and reloaded. He provided three specific dates when this occurred. However, once the computers were reconnected to the network, server profiles restored previous browsing data, including access to explicit content.
Lewis-Bystrzycki, who has been with the department since 1998, claims she faced sexual harassment, gender discrimination, and retaliation for reporting misconduct. She also alleges that firefighters regularly watched pornography at the station.
In August 2016, a judge approved a forensic examination of the computers after determining it wasn’t a fishing expedition. The process, however, was delayed for nearly five months until the city was sanctioned for non-compliance. The city was ordered to cover the costs of the forensic work as part of the penalty.
After news of the sanctions broke, the city’s lawyers filed an emergency motion for a protective order to limit media exposure. They argued that without such a gag order, the plaintiff might unfairly influence the jury pool, harming their right to a fair trial.
The city referenced past reports, including a 2015 FOX 32 story and a recent watchdog article, to support its claim. However, the city did not respond to requests for comment on the motion or the allegations made by attorney Dana Kurtz, who accused the city of evidence destruction and contempt of court.
Kurtz denied leaking information to the press, stating that the media was simply reporting on public court documents. In her response, she criticized the city for its conduct, which led to a default judgment, payment of attorneys’ fees, and multiple motions to compel and sanctions being granted.
She also alleged that the city deliberately destroyed evidence and committed spoliation. Despite these serious claims, local trial lawyer Dan Kirschner said he doubted the case would lead to a criminal investigation.
Kurtz indicated she plans to file spoliation and contempt motions once Garrett completes his report. A hearing on the city's protective order request is scheduled for late next month.
